  • Individual: Smokers are unable to smoke at any eateries due to smoking ban enforced.

  • Smoker caught breaching smoking ban would face a fine of RM10,000 or jailed up to 2 years.

  • Eateries that failed to enforce the law would face a fine of RM2,500-5,000 or jail time up to 6 months.

  • Smoking is only allowed 3meters away from eateries.



Setup a shop equipped with self-service vending machine that sells all kind of beverage and food (the shop do not have kitchen facility hence does not contain a restaurant/eateries license).

Make it an open-air shop serves with table and chair for customers (this distinguish from the areas that prohibit smoking under the regulation which is indoor and air-con space).

There are tons of vending machines nowadays literally you can sell or buy anything from it.

Example like:

It can be coin/cash operate or mobile apps operating.


The current Control of Tobacco Product (Amendment) Regulations 2017:

Prohibits smoking in 21 areas including hospitals & clinic, public toilets & lifts, airports, nursery area, school buses, shopping complexes, petrol stations, stadiums, library area, religious building, internet cafes area, national service training area, rest & recreational areas, observation towers & camp site, any centralized air-con system space, government premises as well as entertainment centres & theatres. But those entertainment centres does not include pubs, discotheques, night clubs, or casinos during their operation hours!


Market Potential (Statistics):

  • Research has shown that 20-30% of customers smoke in eateries.

  • Based on statistic, out of Malaysia’s 29 million population, the number of smokers is estimated to be 9 million or 23 percent.


Alternative Solution(s):

  1. Shutting down their kitchen to comply with technicalities of the ban. But scarify serving food can impact to the revenue drop.

  2. Set aside for smoking space, possible an upper level or next door, where not serving food, possible to apply two different business operate license to separate the business nature.


My Point of View:

I always respect those who do not smoke and also respects the rights of smokers. Smoking is not good, but smokers should be allowed to make their own choices.

Now both the non-smoker and smoker have the choice to enjoy the premises dedicated to them without imposing each other’s choice of lifestyle. Happy ending?



  • There is a six-month grace period to set this up before offenders are fined.

  • If you are a fast thinker, you can even earn some profit by printing and selling “No Smoking” signs when you see this coming last year.
